TERMS AND CONDITIONS OF USE

These Terms and Conditions (“Terms”) govern your access to and use of the digital platforms owned by OTTCO INGENIO CREATIVO, S.A.P.I. DE C.V., including the websites www.mypik.mx and www.behindthepik.com, the mobile application “PIK”, and all social media profiles under the brand name “PIK” (collectively, the “Platform”).

Please read these Terms carefully. By accessing or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms and our [Privacy Policy]. If you do not agree, please refrain from using the Platform.

1. Nature of the Platform

PIK is a curated digital content platform that allows users to explore, collect, and share product and service recommendations. The Platform does not sell, distribute, or directly endorse third-party products, and does not participate in any transaction or customer service process.

PIK publishes external links and information sourced from third-party websites. While we strive for accuracy, PIK does not guarantee that all information is complete, accurate, or up-to-date.

2. User Eligibility

You must be at least 18 years old or have the consent and supervision of a legal guardian to use the Platform. By using the Platform, you declare that you meet this requirement and are legally capable of entering into binding contracts under applicable law.

3. Permitted Use and User Responsibilities

Users may:

  • Browse editorially curated collections and content.
  • Create personal collections and submit third-party links.
  • Follow and interact with other users.

You agree not to use the Platform for unlawful, fraudulent, or harmful purposes, nor to upload, share, or link to content that is offensive, infringing, or misleading. We reserve the right to suspend or terminate access for any breach of these Terms.

4. Third-Party Links and Content

PIK may feature content, links, or tools that direct users to third-party websites. We do not operate or control these websites and are not responsible for:

  • Their content, security, accuracy, or availability;
  • Any loss, damage, or harm resulting from their use;
  • Viruses, tracking technologies, or other risks associated with third-party sites.

Your use of such third-party content is at your own risk and subject to their respective terms and privacy policies.

5. Intellectual Property

All content created by PIK — including but not limited to logos, branding elements, curated content, editorial materials, and proprietary software — is protected by applicable intellectual property laws in Mexico and internationally.

Unauthorized reproduction, distribution, or exploitation of PIK’s proprietary content is strictly prohibited. Third-party trademarks or logos featured on the Platform are the property of their respective owners and are used for identification purposes only.

6. Data Protection and Privacy

We collect and process personal data in accordance with the Mexican Ley Federal de Protección de Datos Personales en Posesión de los Particulares. Full details are available in our Privacy Notice.

We are committed to safeguarding user data and will not sell or share personal information without legal justification or express user consent.

7. Cookies and Tracking Technologies

PIK uses cookies, tracking pixels, and similar technologies to enhance user experience and analytics. Users may opt to disable cookies via browser settings, though certain features may be limited.

When interacting with third-party plugins (e.g., “like” buttons or embedded content), the respective social platforms may collect data under their own terms.

8. Platform Modifications and Availability

PIK may update, suspend, or discontinue the Platform or its features at any time, with or without notice. If services are to be permanently discontinued, we will make reasonable efforts to notify users at least 15 days in advance.

9. Termination of Use

We reserve the right to terminate or restrict access to the Platform at our sole discretion, particularly in cases of misuse, violation of these Terms, or legal compliance requirements.

10. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the United Mexican States. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Mexico City, expressly waiving any other forum that may apply due to present or future domiciles.
